Terms & Conditions

These Terms and Conditions (Terms) govern your use of the MileageFile mobile application, related subscription features and support services (together, MileageFile, we, us or our). By downloading, accessing or using MileageFile, you agree to these Terms.

If you do not agree, do not use MileageFile. You must be at least 16 years old. If you are 16 or 17, you must have the consent of a parent or guardian who accepts these Terms for you.

Our Privacy Policy explains how we handle personal information. It forms part of these Terms.

MileageFile helps you record, classify and report vehicle journeys. Depending on the features you choose, it may use location and motion information to detect a journey, calculate a route and distance, prepare trip records, and produce mileage and logbook reports. You may also manually enter or edit records, add vehicle information, and attach optional photo evidence.

MileageFile is a record-keeping tool only. It is not tax, legal, accounting or financial advice; it does not lodge anything with the Australian Taxation Office (ATO); and it does not guarantee that any report, deduction, logbook or record will satisfy the requirements of the ATO or any other authority. You are responsible for checking every record, retaining supporting evidence and obtaining professional advice where appropriate. MileageFile is not affiliated with, endorsed by or acting for the ATO.

Subject to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to use MileageFile for its intended purpose on Apple devices you own or control.

You must:

• provide accurate information and review automatically detected journeys before relying on them;
• keep your device, account credentials and any backup password secure;
• comply with all applicable road, privacy and tax laws;
• not use, look at or operate MileageFile while driving, except where lawful and safe; and
• not reverse engineer, interfere with, misuse, resell or attempt unauthorised access to MileageFile or its services.

Location, map, motion and device services can be unavailable, delayed or inaccurate. An automatic journey may not start, finish or be recorded as expected. You should review your records and use manual entry where needed.

Trip records and evidence are primarily stored on your device. You control what you enter, edit, export, share, back up or delete.

MileageFile can create an encrypted local backup when you choose to do so. You choose where to save it, such as Files or a cloud storage service you use. We do not receive the backup file or its password. If you lose the password, we cannot recover the encrypted backup.

You are responsible for maintaining copies of records that you need. Deleting the app, resetting your device, deleting local records or losing access to a backup may permanently remove data from your control.

MileageFile may offer a free service and optional MileageFile Pro subscription. At the date of these Terms, the Pro plan removes the monthly Business-trip report size limit and enables the ATO 12-week logbook feature. The app and App Store product screen show the features available with your selected plan.

Features can change where reasonably necessary to maintain, improve, secure or comply with law in relation to MileageFile. We will not materially reduce a paid feature during an already-paid subscription period unless required for legal, security or technical reasons, or unless we give reasonable notice and any remedy required by law.

MileageFile Pro is sold as an auto-renewable subscription through Apple. Apple, not us, processes the payment. At the date of these Terms, the available plan is a one-month subscription. The current Australian price is A$12.99 per month, but the price, tax treatment and currency shown by Apple at purchase are the amount that applies to you.

By purchasing:

• payment is charged to your Apple Account when you confirm the purchase;
• your subscription renews automatically unless you cancel it at least 24 hours before the current subscription period ends;
• Apple may charge your Apple Account within 24 hours before the renewal period starts; and
• you can manage or cancel the subscription in your Apple Account subscription settings. Deleting MileageFile or an account does not cancel an Apple subscription.

You can use the in-app Restore Purchases option if you reinstall MileageFile or use another eligible device with the same Apple Account. Refund requests are handled by Apple under its refund process, subject to your rights under Australian Consumer Law.

We do not receive or store your full payment-card details. If Apple cannot confirm an active entitlement, Pro features may be unavailable until confirmation is restored.

Some MileageFile functions may be available without an account. If you create an account, you must keep your email address and password secure and tell us promptly at Support@smartpixel.com.au if you believe your account has been compromised.

You may submit an account-deletion request from the Account area of the app. We will process it in accordance with our Privacy Policy and applicable law. The request does not delete trip records stored locally on your device, backups you saved to your own storage, or an Apple subscription. You must delete those local items and cancel any Apple subscription separately.

We may suspend or terminate an account or service access where reasonably necessary to protect users, prevent fraud or misuse, comply with law, or address a material breach of these Terms.

MileageFile may use Apple services for purchases and, when you choose to view a route map, Google Maps. Your use of those services may also be governed by their terms and privacy policies. We are not responsible for third-party services, your Apple Account or a storage provider you choose for a backup.

When you choose to export or share a report, file or image, you control the destination and are responsible for checking its contents and recipients.

MileageFile and its content, software, branding and associated intellectual property are owned by or licensed to us. Except for the limited licence above, these Terms do not give you any ownership rights in MileageFile.

You retain ownership of content you create or enter. You give us only the limited rights needed to operate the account, subscription and support functions you request.

We aim to keep MileageFile available and reliable, but do not promise uninterrupted, error-free or perfectly accurate operation. Device settings, GPS signal, operating-system changes, network availability and third-party services can affect the app.

We may update these Terms where reasonably necessary. For material changes, we will provide notice in the app, on our website or by other reasonable means. Continued use after the effective date of the updated Terms means you accept them. If you do not agree, stop using MileageFile and cancel any subscription before its next renewal.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.

To the maximum extent permitted by law, and except for liability that cannot be excluded, our total liability arising from MileageFile is limited to resupplying the relevant service or paying the reasonable cost of having it resupplied. We are not liable for indirect or consequential loss, lost profits, lost data, tax outcomes, penalties or loss caused by your failure to review records, keep backups or use the app safely.

These Terms are governed by the laws of Queensland and the Commonwealth of Australia. Courts in that jurisdiction have non-exclusive jurisdiction, subject to any rights you have under applicable law.
